ORDER This 12th day of August, 1991, the appellees having moved to affirm the judgment of the Court of Chancery dated April 4, 1991 dismissing the derivative action commenced by the appellant against the appellees, it appears that said motion should be granted as to all appellees since it is manifest on the face of appellant's brief that the appeal is without merit. The issues on appeal are clearly controlled by settled Delaware law, Levine v. Smith, Del. Supr., 591 A.2d 194 (1991). To the extent the same involve matters of judicial discretion, clearly there was no abuse of discretion.
